GNWT releases What We Heard report for Trespass legislation

The Government of the Northwest Territories (GNWT) has released the What We Heard Report summarizing feedback from residents on the development of territorial trespass legislation. The report reflects strong public support for modernized tools that help protect private property and enhance community safety in the Northwest Territories.

Between September 24 and October 8, 2025, the Department of Justice invited residents to participate in an anonymous online survey and provide written submissions. A total of 698 contributions were received, with an overwhelming majority expressing support for the introduction of trespass legislation.

Many residents indicated that trespassing is a growing concern in their community and emphasized the need for property owners and lawful occupiers to have more effective tools to respond.

Key findings from the engagement include:

  • 88% of respondents consider trespassing a problem in their community.
  • 94% believe property owners need more tools to remove trespassers.
  • 87% support penalties that include both fines and the option of jail time.
  • 73% support granting property owners and lawful occupiers the right to arrest trespassers.
  • 92% support simplified restitution processes for victims of trespass-related property damage.

Residents also expressed a strong desire for timely legislation, stricter sentencing options, and broader public‑safety measures. Concerns highlighted included Indigenous land rights, potential impacts on people experiencing homelessness, and the need for clear enforcement.

The GNWT introduced Bill 34: Trespass to Property Act during the Fall 2025 sitting of the Legislative Assembly. Public input gathered through this engagement helped inform the development of the Bill, which has undergone clause‑by‑clause review by the Standing Committee on Social Development.
